1) General Provisions
1.1 Fresh Market Conference 2012, hereinafter referred to as “the Conference”, shall be held on 28 September 2012 at the Mazurkas Conference Centre in Ożarów Mazowiecki. Organiser’s Office: ul. Poznańska 98, 05-850 Ożarów Mazowiecki, tel +48 22 721 60 62, http://www.freshmarket.com.pl/.
1.2 The Conference shall be organised by Silvi-Cola F.H. Sp. z o.o., ul. Poznańska 98, 05-850 Ożarów Mazowiecki, NIP PL5671579426, REGON 130426600, KRS 0000136632, represented by www.fresh-market.pl.
1.3 The Organiser is obliged to prepare the Conference, which includes lectures (Forum sessions), meetings with the Merchant Trade Centre (Kupieckie Centrum Handlu) exhibitors, the exhibition and the VIP zone. The Conference begins at 9:00AM and lasts until 7:00PM.
1.4 Lectures will be held according to the Forum Programme published on the Conference official website. The Organiser reserves the right to make changes in the programme. The Organiser undertakes to publish up-to-date information about the Conference on the official website.
1.5 The Organiser provides the Participants with the opportunity to meet the representatives of the Merchant Trade Centre (KCH) exhibitors. The Organiser does not guarantee a permanent presence of the representatives of the Merchant Trade Centre (KCH) exhibitors at the stands. The Organiser does not decide on the sequence of meetings and their length, and does not take responsibility for the results of negotiations with the Merchant Trade Centre (KCH) representatives.
1.6 The Organiser provides the Participants with refreshments: coffee break, lunch and “country buffet”.
A separate element of the Conference is an evening banquet, which takes place from 7:30PM to 1:00AM. In order to take part in the banquet, Participants are required to fill out a form and make the relevant payment during the registration for participation.
1.7 Definitions of terms used in these Regulations:
1.7.1 Organiser: Silvi-Cola F.H. Sp. z o.o., ul. Poznańska 98, 05-850 Ożarów Mazowiecki, NIP PL5671579426, REGON 130426600, KRS 0000136632 represented by www.fresh-market.pl,
1.7.2 Registrant: natural or legal person making the registration of the Participant or Participants, and making the choice of a participation package,
1.7.3 Advertiser: The Registrant or Exhibitor who purchased advertising services as referred to in Annex 3 to these Regulations,
1.7.4 Participant: person registered as part of a package of participation by the Registrant,
1.7.5 Exhibitor: natural or legal person who purchased the exhibition space at the Fresh Market Conference 2012.
1.8 Statement of participation in the Fresh Market Conference 2012 implies the acceptance of these Regulations.
1.9 These Regulations shall come in effect as of 10.01.2012.
2) Enrolment
2.1 In order to participate in the Conference, applicants are required to fill out on-line registration forms available at http://form.freshmarket.com.pl/login.php?lang=pl.
2.2 Applications shall be submitted not later than 25 September 2012.
2.3 The Registrant undertakes to complete the on-line registration form correctly and consistently with the facts. Presented data shall be consistent with the actual company/Participant status.
2.4 The Organiser is not liable for damages resulting from the introduction to the registration form of incorrect data by the Registrant.
The Organiser undertakes to conceal all information (data) received from the Registrant, excluding information designated to be entered in the Conference directory, referred to in Section 2.10.
2.5 In accordance with these Regulations, filling out the form is tantamount to concluding an agreement with the Organiser. It also indicates the acceptance of the provisions of these Regulations, and the observance of order regulations and any other arrangements made between the Participant and the Organiser. The Participant shall, in addition, be obliged to cover the costs of the participation package.
2.6 Costs of participation are set out in Annex 1 to these Regulations. Registration of more than one Participant gives the Registrant the right to obtain a 10% discount on the total cost of the selected package.
2.7 Registration during the promotional period (until 31 July) gives the Registrant the right to obtain a 20% discount on each participation package. Discounts mentioned in sections 2.6 and 2.7 do not combine.
2.8 The Registrant has the choice of two packages: Standard and Premium. Standard package enables access to the lectures (Forum sessions), meetings with Merchant Trade Centre (KCH) exhibitors, VIP zone, general exhibition space, lunch, coffee breaks and “country buffet”, referred to in point 1.6 of these Regulations. Premium package enables access to elements offered by Standard package and, additionally, participation in the evening banquet at Mazurkas Hotel. Participation in the banquet is only possible if the Premium package has been purchased and if its entire cost has been covered.
2.9 The Registrant can upgrade the Standard package offer to the Premium offer for each registered person. This involves submission of a written request to the Organiser’s office no later than 30 days before the Conference and payment of the amount resulting from the difference in cost. In the case of delayed notification, the Organiser does not guarantee the possibility of participation of additional persons in the banquet.
2.10 The Registrant is obliged to add information about his/her company to the Conference directory, within the basic entry form, including the following information: company name, postal address and a description of up to 100 characters, before 20.08.2012.
2.11 The Registrant shall have the right to add an extended, paid description of his/her company (according to the rates indicated in Annex 1) to the Conference directory. The extended entry shall include the company's name, postal address, contact person, phone number, email address, website address and a description of up to 500 characters.
2.12 Addition of an entry to the directory requires the submission of the statement of participation, careful completion of the boxes and consent to publication of presented data. In the case of completing the form later than 40 days before the Conference, the Organiser does not guarantee making the entry in the directory.
2.13 Once the registration process is complete, the Organiser sends a message confirming the registration along with the invoice.
2.14 During the Conference, each registered Participant shall receive the Conference materials and a badge indicating each package purchased. In the case of the Premium package, a nameless invitation to the banquet shall be enclosed to the badge.
3) Stand
3.1 In order to purchase a stand for the Fresh Market Conference 2012, the applicants shall either make an appropriate notification in the on-line registration form at http://form.freshmarket.com.pl/login.php?lang=pl,
or directly contact the Organiser, tel. +48 22 721 60 62.
3.2 The Organiser enables the Exhibitors to choose their exhibition space in accordance with the applications filing order, technical and organisational conditions, and the availability of exhibition space, or no later than 10 days before the Conference.
3.3 The minimum exhibition space equals 4 square metres (2x2 metres). The size and price of stands are described in Annex 2.
3.4 The Exhibitor receives the right to add a free extended entry to the Conference directory described in the "Exhibitors" section (See Section 2.11).
3.5 The Exhibitor shall have the right to add a company logo to the extended entry. Graphic materials delivered by the Exhibitor no later than 40 days before the Conference shall meet the technical requirements specified by the Organiser in Annex 3. Otherwise, the Organiser may refuse to publish the logo.
3.6 Stands shall be installed on 28.09.2012 between 6:00AM and 8:00AM. The wish to install a stand before that date shall be reported and agreed with the Organiser in advance. The Exhibitors undertake to complete the installation and preparation of their stands by 8:00AM.
3.7 In the case of a purchase of an exhibition space together with accessories supplied by the Organiser, the Organiser undertakes to prepare the exhibition stand and make it available to the Exhibitor from 7:00AM.
3.8 Stands are vacant - no walls separating individual exhibition spaces.
3.9 The Organiser shall provide the stands with access to electricity. The Exhibitors shall prepare their own electrical wiring within the stand space (e.g. extension cords, spot lights).
3.10 Exhibition stands shall be equipped with movable stand parts, such as tables, chairs, sofas, shelves, countertops, advertising walls, roll-up banners, etc.
3.11 Distribution of non-standard pieces of equipment on the stand, such as refrigerators, scales, boxes, etc., requires prior arrangement with the Organiser.
3.12 Elements of stands may be collected and stored on 27.09.2012 in the MCC magazine. The Exhibitor shall notify the Organiser about the wish to have the elements stored, and determine the time of their delivery to the MCC magazine, via e-mail: ewelina.t@freshmarket.com.pl or fax: +48 22 721 60 63
3.13 Each delivered element shall be previously reported to the Organiser. Items delivered to the MCC magazine shall be signed in a visible place with the full company name and number of the stand for which they are intended. In the absence of marking, or improper or illegible description, the Organiser is not liable for any losses.
3.14 The Organiser reserves the right to refuse to issue exhibits considered unsafe or inconsistent with the provisions of these Regulations.
3.15 The Exhibitor shall not attach any items to the building and its equipment. Sticking posters with a tape, suspending stand components at ropes or cords and hammering nails shall be prohibited.
3.16 The Exhibitor shall not exceed the designated exhibition space or arrange the elements outside its borders.
3.17 The Exhibitor may place any number of ads and stand elements within individual exhibition space.
3.18 It shall be prohibited to install ads and other elements outside the stand without prior arrangement with the Organiser.
3.19 Stands disassembly begins after 7:30PM and shall be completed by 11:00PM.
3.20 It is not allowed to disassemble stands during the Conference. Exhibitors who will not abide the ban will be required to pay a contractual penalty in the amount of PLN 3,000.
3.21 The Exhibitor is obliged to reinstate the occupied area to its prior state. Stand elements left without notice to the Organiser and not removed by the Exhibitor during disassembly shall be deemed abandoned property.
3.22 Non-standard stand elements and large format banners may be stored in the magazine after the disassembly. Prior arrangement with the Organiser shall be required in this case. Stored items shall be collected the next working day by 6:00PM. The Organiser understands working days as weekdays - Monday to Friday.
3.23 Items left in the magazine after that date shall be considered abandoned property and will be utilised.
3.24 Responsibility for damage caused during the installation of stand elements and their disassembly, or by inadequate stand equipment, shall lie with the exhibitor.
3.25 It is prohibited to occupy space arbitrarily or conduct advertising campaigns outside the rented stand.
4) Advertising Services
4.1 In order to take advantage of advertising services, please include a notification in the on-line registration form: http://form.freshmarket.com.pl/login.php?lang=pl , or contact the Organiser directly: tel+48 22 721 60 62.
4.2 Available advertising services and their prices are specified in Annex 3.
4.3 The choice of advertising space is related to the applications filing order. The Advertiser shall reserve the advertising space and cover its cost no later than 50 days before the Conference.
4.4 Graphic materials delivered by the Advertiser shall meet the technical requirements specified by the Organiser (Annex 3). CD with graphic materials shall be delivered directly to the Organiser’s office, or to the designated ftp address. In the case of failure to provide specific pattern information, the Organiser shall not consider complaints relating to the colour of printing.
4.5 In the case of failure to meet the above requirements, the Organiser has the right to refuse to publish the advertisement.
4.6 Advertisers agree to deliver leaflets, brochures and catalogues (to be used as the Conference materials) no later than 10 days before the Conference. The Organiser does not guarantee the distribution of advertising materials delivered after this deadline.
4.7 Large format banners intended for installation on the MCC premises shall meet technical requirements specified in Annex 3. In the case of failure to meet the above requirements, the Organiser has the right to refuse to publish the advertisement. Responsibility for installation and disassembly of banners shall lie with the MCC.
4.8 Forum lecture shall last for 10 minutes and its price is specified in Annex 3. The Advertiser shall introduce the speaker and the topic of a lecture no later than 15 July. In the case of exceeding the prescribed length of a lecture, the Organiser is likely to demand payment for an extended lecture proportionately to its length.
4.9 If the Advertiser wishes to use a non-standard form of advertising that is not described by the Regulations and Annexes, he/she shall discuss it with the Organiser.
4.10 It shall be prohibited to spread leaflets, brochures and catalogues, and other items functioning as advertisements, throughout the Conference facility without the consent of the Organiser.
5) Payments
5.1 The Registrant is obliged to pay fees associated with participation in the Conference according to the rates set by the Organiser. Fees shall be paid during the on-line registration, when the invoice is produced for the requested service.
5.2. Bank transfer payment is possible, upon prior notice to the Organiser’s office. Payment shall be made within the period specified in the invoice. In payment matters, please contact the Organiser’s accounting office: tel+48 22 721 60 65.
5.3 To benefit from discounts, the applicants shall register within the period of promotion determined by the Organiser (paragraph 2.7).
5.4 The currency translation of EUR-PLN shall be executed according to the current EUR exchange rate set by the NBP (National Bank of Poland), in consideration of submission date.
5.5 Any delay in payment under these Regulations shall give rise to the payment of interest at a rate equal to twice the rate of statutory interest.
5.6 Making all payments specified by these Regulations shall be a condition for participation in the Conference.
6) Security and Maintenance
6.1 At the time of assembly and disassembly, as well as during the Conference, responsibility for stand maintenance and supervision shall lie with the Exhibitor. Responsibility for the overall security of the Conference facility shall lie with the MCC, which is authorised to take any control measures to ensure safety.
6.2 The Organiser shall not insure and is not responsible for the damage, theft and loss of possessions and valuables belonging to the Participants, as well as for damages caused by the Participants and the force majeure.
6.3 Responsibility for the security of the Participants in the Conference hotel and within the Conference site shall lie with the security service employed by the MCC.
6.4 Filming, recording and photographing without the consent of the Organiser shall be prohibited.
6.5 The Exhibitors are required to insure their property, including the exhibited equipment, and to insure themselves against civil liability.
6.6 The Exhibitor shall immediately report any damage to the Organiser.
6.7 Stand maintenance during the Conference, as well as cleaning up after stand disassembly is the responsibility of the Exhibitor. Waste shall be removed according to the Organiser’s guidelines available at locations indicated by the Organiser.
6.8 Participants are financially liable for damage caused by themselves, both on the Conference premises, and in the places of accommodation.
7) Cancellation of Participation
7.1 The Participant shall have the right to withdraw from participation in the Conference and to obtain reimbursement of 50% of the paid amount. In order to obtain reimbursement, the Participant shall submit written notification of withdrawal from participation in the Conference to the Organiser's office no later than 30 days before the Conference. In the case of notifications received after this date, the Organiser shall not return the money.
7.2 The Registrant has the right to change the Participants’ personal data which has been registered. For this purpose, the Registrant shall deliver the new personal data of Participants to the Organiser’s office no later than 7 days before the Conference. Information submitted after this deadline might not acknowledged by the Organiser.
8) Complaints
8.1 Any claims by Exhibitors and Participants to the Organiser shall be prepared in writing and sent by registered mail within 7 days from the date of the end of the Conference. After the expiry of the above specified time, no claims will be considered.
8.2 The Exhibitor’s complaints arising from the implementation of the agreement do not entitle the Exhibitor to delay the transmission of claims, in whole or in part.
8.3 Any claims against the Organiser of the Conference by the Participants shall be submitted in writing by registered mail to the registered address of the Organiser.
9) Protection of Personal Data
9.1 The administrator of personal data collected for the Fresh Market Conference 2012 is Silvi-Cola FH Sp. z o.o.
9.2 Any person registering to participate in the Conference has the right to control processed personal data , and, in particular the right to:
9.2.1. determine the data administrator, the address of its seat and its full name,
9.2.2. request to complete, update, or correct personal data, temporary or permanent suspension of its processing, or deletion, if they are incomplete, outdated, untrue or collected in violation of the law or are no longer required for the purpose for which they were collected.
9.3 According to the Act on Personal Data Protection dated 29 August 1997 (Journal of Laws of 2002 No 101, item 926, as amended), the Organiser of the Conference does not provide, sell or lend personal data of the Participants to other people or institutions. Personal data provided by the Participant shall be treated as confidential and used solely for the purpose of communication between the Participant and the Conference Organisers.
10) Final Provisions
10.1 All the Conference Participants have the right to use Hotel Mazurkas parking spaces for free for the duration of the Conference. After entering the car park, a parking card shall be collected at the entrance gate. Before leaving the car park, the card shall be punched at the hotel reception. Free parking shall apply from 5:00AM on 28.09.2012 to
1:00AM on 29.09.2012. In the case of cars left at the parking lot outside the hours specified in these Regulations, the owners shall be obliged to cover the parking costs.
10.2 The Organiser shall not book hotel accommodation and will not incur its costs. The Conference Participants can individually book Hotel Mazurkas rooms and get a special discount. The "Fresh Market” password enables the discount. Responsibility for discounts shall lie with Hotel Mazurkas.
10.3 The Participants shall cover the transport costs themselves.
10.4 In the case of disturbing customary and accepted standards and serious breaches of the Regulations of the Conference, the Organiser has the right to remove the Exhibitor or the Participant from the site of the Conference, by law enforcement officers.
10.5 The organiser reserves the right - in the event of circumstances beyond his control - to cancel, or postpone the Conference. If the Conference does not take place due to reasons beyond the Organiser and on which he had no influence, the Participant is not entitled to any compensation or refund of any fees associated with attending the Conference.
10.6 In any matters not regulated herein, the provisions of the Civil Code shall apply.
10.7 Any disputes arising out of these Regulations shall be resolved by an appropriate court.
